Terms of Service

Acceptance of these terms

By creating an account or using RacquetIQ, you agree to these Terms and to our Privacy Policy. If you do not agree, do not use the service. If you use RacquetIQ on behalf of a club or another person, you represent that you are authorized to do so, and "you" means both you and that club.

The service

RacquetIQ provides tools for clubs and their members to schedule, enroll in, message about, and pay for in-person racquet-sports coaching and programs. RacquetIQ is a platform: the coaching services themselves are provided by your club, not by RacquetIQ, and your club sets its own prices, schedules, and program and cancellation policies.

There are two different relationships in these Terms, and it is worth separating them. A club is our customer: it subscribes to RacquetIQ and is responsible for how it runs its programs. A member — a parent, guardian, or adult player — uses RacquetIQ to deal with their club. Sections about plans and billing apply to clubs; sections about bookings apply to members; the rest applies to everyone.

Accounts and eligibility

You are responsible for keeping your account credentials secure and for activity under your account. You agree to provide accurate information and to keep it up to date, and to tell us promptly if you believe your account has been used without your permission. RacquetIQ accounts are for adults: you must be 18 or older to create one. A junior athlete does not hold an account — a parent or guardian, or the club, maintains their roster information.

Minors and parental consent

A parent or guardian who enrolls a child is responsible for that child's participation and for the information they provide about the child. By enrolling a child, you confirm that you are their parent or legal guardian, or are otherwise authorized to act for them, and you consent to the collection and use of the child's information as described in the Privacy Policy. Children are never sent marketing and are excluded from marketing audiences, and there is no private, unmonitored channel between a coach and a minor.

Plans, free trial, billing, and cancellation

This section applies to a club or coach who subscribes to RacquetIQ. The plans, their prices, the billing periods available, and what each plan includes are shown on our pricing page and again at checkout before you pay. Those pages are the current statement of what a plan costs; these Terms describe how the billing works.

• Free trial — new subscriptions start with a 14-day free trial and no card is required to begin. If you do not enter payment details, the trial simply ends and you are not charged.
• Auto-renewal — once you start a paid subscription, it renews automatically at the end of each billing period (monthly or annual, whichever you chose) at the then-current price for your plan, until you cancel. We will charge the payment method on file.
• Renewal notice — we will remind you by email before a paid term renews and before a free trial converts, with the amount, the date, the renewal term, and a direct link to cancel. For an annual plan that reminder goes out between 15 and 45 days before the renewal date.
• Cancelling — you can cancel at any time from your account settings, in the same number of steps it took to subscribe, without calling or emailing anyone. Cancellation stops future renewals; your subscription stays active until the end of the period you have already paid for, and you keep access until then.
• Usage-based charges — some plans include an allowance of text messages and bill overages at the rate shown on the pricing page. Overages are billed with your next invoice.
• Price changes — we may change prices. For a change that affects you, we will give you at least 30 days' notice before it takes effect, and you may cancel before then if you do not want to continue at the new price.
• Taxes — prices exclude sales and similar taxes, which we add where we are required to collect them.
• Failed payments — if a payment fails we will retry and let you know. If it stays unpaid we may suspend the subscription; we will not delete your data because of a failed payment without telling you first and giving you a chance to export it.

Fees for a club's subscription are separate from what a member pays that club for coaching. Refunds, credits, and make-ups for a member's booking are governed by the club's own cancellation policy, described below — not by this section.

Bookings, cancellations, and make-ups

When you book a class or lesson, you are reserving a spot subject to availability and to your club's policies. Cancellations, refunds, credits, and make-ups are governed by your club's cancellation policy, which is applied consistently through RacquetIQ. Your club — not RacquetIQ — is responsible for delivering the booked session and for its own program decisions.

Payments

Depending on your club, payment for a booking may be taken in one of three ways: securely in-app by card (processed by Stripe); at your club's own external registration or payment system, with your spot held until payment is confirmed; or by an invoice your club sends you directly. RacquetIQ does not store full card numbers. Fees, taxes, and refunds are set and handled by your club except where in-app card payments are processed by our payment processor.

SMS program terms

If you opt in to text messages, your club may send you recurring SMS messages through RacquetIQ, including booking confirmations, schedule updates, reminders, and — where you have separately opted in — occasional promotional messages. You opt in by giving your phone number and agreeing to receive texts (for example when booking or in your messaging preferences). Consent to receive texts is not a condition of any purchase.

Message frequency varies. Message and data rates may apply. Reply STOP to any message to unsubscribe — you will receive one confirmation and then no further texts unless you opt in again. Reply HELP for help, or contact us at the email below. Supported carriers are not liable for delayed or undelivered messages.

We do not sell or share your mobile number or SMS opt-in information with third parties or affiliates for their own marketing. For more on how your information is handled, see our Privacy Policy.

If you run a club: your responsibilities

RacquetIQ sends messages, holds rosters, and takes bookings on your behalf, which means some obligations are yours and cannot be ours. As a club using RacquetIQ, you agree that:

• You have the right to give us the member information you upload or enter, and you will keep it accurate.
• You have obtained the consent you need before messaging a member — including, for text messages, consent that meets the requirements of the Telephone Consumer Protection Act and the carriers' rules — and you will honor opt-outs promptly.
• You are responsible for the content of what you send, including anything an assistant drafted for you and you approved.
• You will not use RacquetIQ to send unsolicited marketing to people who have not agreed to hear from you.
• You are responsible for your staff's and coaches' use of their accounts, and for removing access when someone leaves.
• You are responsible for your own program, safety, refund, and cancellation policies, and for meeting the legal obligations that come with coaching minors.

Your data, and leaving

Your club's and your own content remains yours. We claim no ownership of your roster, your schedule, your messages, or your records; you grant us only the limited rights needed to operate the service for you.

You can export your data at any time from inside the product — you do not need to ask us, open a support ticket, or negotiate anything, and this does not depend on your account being in good standing. You can delete your account and your personal information from your account settings. If you cancel, you keep access until the end of the period you paid for, and you can export up to that point; after an account closes we retain data only for as long as the Privacy Policy describes.

We will not hold your data hostage to keep you as a customer. If a technical problem prevents an export, contact us and we will provide the data another way.

Acceptable use

You agree not to:

• Use RacquetIQ for any unlawful, harmful, or abusive purpose, or to harass any person.
• Access or attempt to access another user's account or information without authorization.
• Interfere with, disrupt, or attempt to circumvent the security of the service.
• Use the service to send spam or messages to people who have not consented to receive them.
• Scrape, resell, or redistribute the service or another club's data.

Third-party services

RacquetIQ relies on third parties to work: a payment processor for card payments, a messaging provider and mobile carriers for text messages, an email provider, hosting providers, and an AI provider for the drafting features described in the Privacy Policy. Your use of some of these may also be subject to their own terms — card payments, for example, are processed under our payment processor's terms. We are not responsible for a third party's own acts or omissions, and carriers are not liable for delayed or undelivered messages.

Assistant and drafted content

RacquetIQ includes an assistant that drafts replies and suggestions for your staff to review. Drafts are suggestions only: a person on your team reads and approves anything before it is sent, and the assistant cannot send a message, take a payment, or decide a booking on its own. Drafted content can be inaccurate or inappropriate for a situation, and it is not professional, legal, medical, or coaching advice. You are responsible for reviewing it and for what you send.

Early access and changes to the service

Some features are offered while they are still being built, and are labelled as such in the product. Early-access features may change, may be less reliable than the rest of the service, and may be withdrawn. We may also add, change, or remove features over time. If we discontinue a feature you depend on, or the service as a whole, we will give you reasonable notice and time to export your data.

Intellectual property

RacquetIQ and its software, design, and content are owned by Tennis Beast LLC and its licensors and are protected by law. You may use the service only as permitted by these Terms. Your club's and your own content remains yours; you grant us the limited rights needed to operate the service.

Feedback

If you send us ideas or suggestions about the product, we may use them without restriction and without owing you anything for them. You do not have to send us feedback, and we will not treat you differently if you do not.

Disclaimers and limitation of liability

The service is provided "as is" and "as available," without warranties of any kind to the fullest extent permitted by law. We do not warrant that the service will be uninterrupted or error-free. RacquetIQ is not responsible for the coaching, programs, safety, supervision, or conduct of any club or its staff.

To the fullest extent permitted by law, Tennis Beast LLC will not be liable for indirect, incidental, special, consequential, or punitive damages, or for lost profits, revenue, or data, arising from your use of the service. To the fullest extent permitted by law, our total liability for all claims relating to the service in any 12-month period will not exceed the greater of the amounts you paid us for the service in the 12 months before the claim arose, or one hundred dollars.

Some states do not allow certain limitations, so parts of this section may not apply to you. Nothing in these Terms limits liability that cannot be limited by law.

Indemnification

If you use RacquetIQ to run a club, you agree to defend and indemnify Tennis Beast LLC against third-party claims, damages, and reasonable costs arising from your programs, your messaging to your members, the member information you provide to us, or your breach of these Terms. We will tell you promptly about any such claim and let you control the defense of it, and we will not settle it without your agreement. This does not apply to a claim caused by our own breach of these Terms.

Termination

You may stop using RacquetIQ and delete your account at any time. We may suspend or end access to the service if you violate these Terms, fail to pay, or to protect the service or other users; except where an immediate suspension is needed for safety, security, or legal reasons, we will tell you first and give you a chance to fix the problem. On termination you keep the export rights described in "Your data, and leaving." Some provisions, by their nature, survive termination — including intellectual property, disclaimers, limitation of liability, indemnification, and the dispute section below.

Disputes and governing law

If something goes wrong, please contact us first at the email below. Most problems are resolved faster this way than by anything formal, and we will work with you in good faith for at least 30 days before either of us starts proceedings.

These Terms are governed by the laws of the State of California, without regard to its conflict-of-laws rules. Any dispute that is not resolved informally will be brought in the state or federal courts located in California, and both you and we consent to the jurisdiction of those courts. Nothing here prevents either of us from seeking an injunction to protect intellectual property or account security, or from bringing a claim in small claims court.

General

• Entire agreement — these Terms and the Privacy Policy are the entire agreement between you and us about the service, and replace any earlier understanding about it.
• Severability — if any provision is unenforceable, the rest stays in force.
• No waiver — if we do not enforce a provision straight away, we have not given it up.
• Assignment — you may not transfer these Terms without our written consent; we may transfer them to an affiliate or in connection with a merger, acquisition, or sale of the business, and the Privacy Policy continues to apply.
• Notices — we will send notices to the email address on your account, and you can send notices to us at the email address below. It is your responsibility to keep your email address current.
• Force majeure — neither of us is liable for a delay or failure caused by something outside our reasonable control, such as a natural disaster, an outage at a provider we depend on, or a carrier failure.
• No third-party beneficiaries — these Terms do not give rights to anyone who is not a party to them.

Changes to these terms, and contact

We may update these Terms as the service or the law changes. The current version will always be posted here with the date it was last updated, at the top of this page. For a change that materially affects your rights or what you pay, we will give you notice by email or in the app before it takes effect; continuing to use the service after that means you accept the updated Terms, and if you do not, you may cancel.
